These Terms of Service ("Terms") constitute a legally binding agreement between ExpressWeb Labs ("Company," "we," "us") and the client ("Client," "you"). By purchasing, commissioning, or using any service provided by ExpressWeb Labs, you acknowledge that you have read, understood, and agreed to these Terms in full.

1. Scope of Services

1.1 ExpressWeb Labs provides website-related services including, but not limited to:

• Website design and development (manual and AI-assisted)
• Static and dynamic website deployment
• Website maintenance and management plans
• Hosting coordination and deployment

1.2 Services are delivered according to the package selected by the Client at the time of purchase. Any service not explicitly included in the selected package is outside the scope of work.

2. Client Responsibilities

2.1 The Client agrees to:

• Provide accurate, lawful, and complete information
• Supply required content (text, images, branding) promptly
• Respond to communications in a timely manner

2.2 The Client confirms that all materials provided are legally owned or licensed and do not infringe on third-party rights.

3. Payments & Fees

3.1 Upfront Payment Required
All projects require full payment before development or delivery begins unless otherwise stated in writing.

3.2 Pricing
Pricing is agreed upon prior to work commencement. Any additional requests outside the original scope may incur additional fees.

3.3 Administrative Fee & Refund Policy

• If payment has been made and the Client subsequently requests actions that are unreasonable, unlawful, technically infeasible, or outside the agreed scope, ExpressWeb Labs reserves the right to terminate the project.
• In such cases, the Client will receive a refund minus a non-refundable administrative fee of $1 USD, which covers processing, consultation time, and administrative costs.
• No refunds are issued once development work has commenced beyond preliminary setup.

4. Revisions & Change Requests

• Reasonable revisions aligned with the agreed scope are included as specified in the selected package.
• Requests considered out of scope may require additional fees or may be declined at ExpressWeb Labs’ discretion.

5. Right to Refuse or Terminate Service

• ExpressWeb Labs reserves the right to refuse or terminate service if the Client requests illegal, unethical, or harmful content, engages in harassment, threats, or abusive behavior, or requests actions that violate platform policies, laws, or these Terms.
• Upon termination, refunds (if applicable) will follow Section 3.3.

6. Hosting & Maintenance

• Hosting may be provided via modern static or managed hosting solutions selected by ExpressWeb Labs.
• Maintenance plans cover uptime monitoring, minor content updates, and basic support as described in the selected package.
• ExpressWeb Labs is not responsible for outages or issues caused by third-party providers, client-side changes, or force majeure events.

7. Intellectual Property

• Upon full payment, the Client is granted a license to use the final delivered website for its intended purpose.
• ExpressWeb Labs retains the right to reuse general design concepts, code patterns, and frameworks, and display completed projects in portfolios, case studies, and promotional materials.

8. Limitation of Liability

• ExpressWeb Labs shall not be liable for loss of profits, data, or business opportunities, or indirect, incidental, or consequential damages.
• Total liability shall not exceed the total amount paid by the Client for the specific service.

9. No Guarantees

ExpressWeb Labs does not guarantee business results, revenue increases, search engine rankings, or customer acquisition outcomes.

10. Confidentiality

Both parties agree to keep confidential any non-public information exchanged during the course of the project.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

12. Amendments

ExpressWeb Labs reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.

13. Acceptance

By submitting payment or commissioning services, the Client confirms acceptance of these Terms of Service in full.
